      Trackmedium, LLC ("Trackmedium," "we," "our," or "us") is committed to protecting personal data and handling it with transparency and integrity. This Privacy Policy explains how we collect, use, disclose, and safeguard personal data in connection with:

      - our websites, including pages that link to this Privacy Policy

      - our marketing, sales, and customer support activities

      - our business software and related services (the "Services"), including our mobile application (the "App")


      Our websites, Services, and App are intended for business use. This Privacy Policy describes Trackmedium's practices. It does not describe how our business customers process personal data within their own organizations or under their own policies.

      2. Customer Data in Trackmedium Products

      Trackmedium provides business software and related services. Personal data that a Trackmedium customer uploads, stores, or otherwise makes available in the Services ("Customer Data") is controlled by that customer.

      - Customer role:The customer determines what Customer Data is uploaded, how it is used, and the legal basis for processing it.

      - Trackmedium role:Trackmedium processes Customer Data to provide, secure, maintain, and support the Services, and to comply with applicable law, consistent with our agreements with the customer.


      Trackmedium does not have a direct relationship with individuals whose personal data is included in Customer Data, unless Trackmedium separately collects personal data from them as described in this Privacy Policy.


      Requests about Customer Data

      If you have questions about Customer Data in a Trackmedium customer account (for example, if your employer uses Trackmedium), please contact that organization directly. Where required, Trackmedium will support our customers in responding to requests consistent with our contractual commitments and applicable law.


      3. HPersonal Data Trackmedium Collects Directly

      In addition to Customer Data, Trackmedium may collect personal data directly when you visit our websites, request information, use the App, or interact with us.


      3.1 Information you provide

      We may collect:

      - Business contact information: name, email address, phone number, employer, job title, mailing address

      - Account information: username and password or other credentials (if you create an account on our websites, portals, or App)

      - Sales and onboarding information: details you submit through forms, demo requests, or contracts

      - Support and communications: messages you send us, support tickets, feedback, survey responses

      - Billing information: subscription and invoicing details. Payment card data is generally handled by third-party payment processors (see Section 8)

      - Signature (App only, if applicable): if you use App features that capture a signature (where available)

      - Comments and testimonials (if you choose to provide them): such as reviews, feedback, or testimonials submitted to us


      3.2 Information collected automatically

      When you use our websites and App, we may collect:

      - Device and network information: IP address, unique device identifier, browser type, device type, operating system, App version, and similar technical information

      - Dates and times of activity: timestamps for visits to and use of our websites and App

      - Usage information: pages and screens viewed, features used, time spent, navigation paths, and interaction data

      - Referring information: URLs that refer visitors to our websites

      - Search terms: search terms used to reach our websites or locate our App (where available)

      - Performance data: such as crash reports and diagnostic data (particularly for the App)

      - Approximate location: approximate location inferred from IP address

      - Precise location (App only, if enabled)): if you allow location permissions on your mobile device, we may collect precise location information to support App features that require it. You can disable location permissions through your device settings.

      3.3 Call recordings and related information

      We may record and store telephone calls or meetings with Trackmedium (for example, sales calls, support calls, or customer success calls). Recordings may include voice, and may include related metadata such as call time, participants, and call notes. Where permitted by law, we may also use tools to help generate summaries, action items, and follow-up tasks based on the call.


      3.4 Sensitive personal data

      We do not intentionally collect sensitive personal data unless it is required for a specific feature or service and collected in accordance with applicable law. Please do not submit sensitive personal data to Trackmedium unless requested and clearly necessary.


      4. Choosing Not to Share Personal Data

      Where we need personal data to provide information you request, respond to an inquiry, create an account, provide support, or provide the Services, we may not be able to provide the requested information or Services if you do not provide the personal data we request (or if you later ask us to delete it), subject to applicable law.


      5. How We Use Personal Data

      We use personal data for the following purposes:

      - Provide and operate the Services and App, including account setup, authentication, access control, feature delivery, and customer administration

      - Support and communications, including responding to requests, providing technical support, and sending service notices and administrative messages

      - Billing and transactions, including managing subscriptions, invoices, and payments

      - Security and integrity, including monitoring for suspicious activity, preventing fraud and abuse, and enforcing our terms

      - Improve and develop, including analyzing performance, troubleshooting, improving our websites, Services, and App, and developing new features

      - Marketing and sales, including sending product information and marketing communications where permitted by law, measuring campaign performance, and understanding engagement

      - Call quality, training, and follow-up, including quality assurance, training, coaching, and generating call summaries, scripts, action items, or customer follow-up tasks

      - Legal and compliance, including complying with legal obligations, responding to lawful requests, and protecting Trackmedium's rights and users


      De-identified and aggregated data

      We may combine personal data or remove identifiers to create de-identified or aggregated data for analytics, reporting, and improving our websites, Services, and App. We do not attempt to re-identify de-identified data except where permitted by law.


      6. Legal Bases for Processing

      Where required by applicable law (including in the EEA and UK), we rely on one or more of the following legal bases:

      - Contract: processing necessary to perform a contract or take steps at your request before entering into a contract

      - Legitimate interests: operating our business, improving our Services and App, securing our systems, preventing fraud, and maintaining service quality, where our interests are not overridden by your rights

      - Consent: where required (for example, certain cookies, certain marketing communications, and certain App permissions such as precise location). You may withdraw consent at any time where applicable

      - Legal obligation: processing necessary to comply with legal requirements


      7. How We Share Personal Data

      We do not sell personal data.

      We may share personal data in the following circumstances:

      - Service providers and subprocessors: vendors that help us operate our business and provide the Services (for example, hosting, analytics, customer support tools, email delivery, CRM, call-recording and customer communication tools). These providers are authorized to process personal data only as needed to provide services to us and under appropriate contractual protections.       - Customer organizations: if your employer or another organization provides you access to the Services, we may share information about your use of the Services with that organization as needed for administration, security, and support

      - At your direction: we may share personal data with third parties when you instruct us to do so (for example, in connection with an integration you enable, where applicable)

      - Legal and safety: to comply with law, respond to lawful requests, protect rights and safety, prevent fraud or abuse, or address security incidents

      - Business transactions: if we are involved in a merger, acquisition, financing, reorganization, or sale of assets, personal data may be transferred as part of that transaction, subject to appropriate protections


      8. Payment Processing

      Payments and payment card details are typically processed by third-party payment processors. Trackmedium does not store full payment card numbers on its own systems unless explicitly stated for a specific payment method. Transaction and subscription records may be retained for accounting and compliance purposes.


      9. Cookies, Pixel Tags, and Similar Technologies

      We use cookies, pixel tags, and similar technologies to operate our websites, remember preferences, enable support interactions, understand website usage, measure marketing performance, and improve performance. Some cookies are essential for functionality.


      9.1 What are cookies?

      Cookies are small data files stored on your computer or mobile device by a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your device until deleted) to provide a more personal and interactive experience.


      9.2 Cookie categories

      We may use:

      - Strictly necessary cookies (required for core website functionality)

      - Functional cookies (to remember preferences)

      - Support and communication cookies (for example, chat and customer interaction tools)

      9.3 Pixel tags (web beacons)

      Pixel tags (also known as web beacons or clear GIFs) are small code snippets embedded on webpages or in emails that help us understand engagement and measure the effectiveness of communications and marketing campaigns. Pixel tags may collect information such as device and browser data, IP address, and interactions with emails or webpages. The information we collect using pixel tags is not linked to your personal data.


      9.4 Analytics

      We use analytics tools to better understand the functionality of our websites and improve performance. For example, we use Google Analytics to collect information such as how visitors use our websites, including pages visited, time spent, and how visitors navigate between pages.


      9.5 Disabling cookies and analytics

      You can typically remove or reject cookies through your browser settings. If you do not accept cookies, some website features may not function properly.


      For Google Analytics, you can also prevent certain analytics collection by installing the Google Analytics Opt-out Browser Add-on (available from Google).


      9.6 Targeted advertising choices

      Some third parties that collect information about your activities on websites and in mobile applications may provide choices regarding the use of your browsing behavior for targeted advertising. Depending on your location, you may be able to opt out of targeted advertising through industry programs such as:

      - the Digital Advertising Alliance

      - the European Interactive Digital Advertising Alliance


      9.7 Do-Not-Track

      Because there is not yet a consistent industry standard for responding to browser-based Do-Not-Track (DNT) signals, our websites do not currently respond to DNT signals.


      10. Information from Social Networking Sites

      Our websites may include interfaces that allow you to connect with social networking sites ("SNS"). If you choose to connect to an SNS through our websites, you authorize us to access, use, and store information that you have made available through that SNS based on your settings with the SNS. We will access, use, and store that information in accordance with this Privacy Policy. You can revoke our future access to that information by changing your SNS settings.


      11. International Data Transfers

      Trackmedium may transfer personal data to countries other than the country where it was collected, including the United States. Where required by law, we use appropriate safeguards for international transfers, which may include Standard Contractual Clauses approved by the European Commission, data protection agreements, and other legally recognized transfer mechanisms.


      12. Data Retention

      We retain personal data only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

      - provide the Services and App

      - maintain business relationships

      - comply with legal, tax, and accounting obligations

      - resolve disputes and enforce agreements

      - protect Trackmedium and our users


      Retention periods vary depending on the type of data and the reason it is processed. Where feasible, we de-identify or delete personal data when it is no longer needed.


      Customer Data in the Services is retained and deleted in accordance with our customer agreements and customer instructions, subject to legal requirements.


      13. Your Rights and Choices

      13.1 General choices

      - Marketing emails: You can opt out of marketing emails using the unsubscribe link in the message. You may still receive administrative or service-related communications.

      - Cookies: You can control cookies through browser settings and, where available, our cookie preference tools.

      - App permissions: You can control App permissions (such as location) through your mobile device settings.


      13.2 EEA, UK, and similar jurisdictions

      Depending on applicable law, you may have the right to:

      - access your personal data

      - correct inaccuracies

      - request deletion

      - object to processing or request restriction

      - request data portability

      - withdraw consent where processing is based on consent

      - lodge a complaint with a data protection authority


      13.3 US State Privacy Rights

      Depending on where you live and applicable law, you may have rights to:

      - access, delete, correct, or obtain a copy of personal data

      - opt out of certain processing, such as targeted advertising, sales, or sharing of personal data as those terms are defined by applicable law

      - appeal a decision regarding a request where required by applicable law


      We may need to verify your identity before responding. If you submit a rights request, we will respond within the timeframe required by applicable law.


      13.4 Requests involving Customer Data

      If your request relates to Customer Data in a Trackmedium customer account, please contact the customer directly. Trackmedium will assist customers in fulfilling requests where required and consistent with our contractual commitments.

      14. Children's Privacy

      Our websites and Services are intended for business use and are not directed to children. We do not knowingly collect personal data from children.


      15. Third-Party Links and Services

      Our websites or Services may link to third-party websites or services. Their privacy practices are governed by their own policies, and Trackmedium is not responsible for those practices.


      16. Security

      We use reasonable administrative, technical, and organizational measures designed to protect personal data. These measures may include encryption in transit, access controls, and vulnerability management practices. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.


      17. Changes to This Privacy Policy

      We may update this Privacy Policy from time to time. We will post the updated version on our website and update the Effective Date. If changes are material, we may provide additional notice as required by applicable law.
